Terms Of Service
Soaring Eagle PTR reserves the right to refuse service to anyone.
No New Sign Ups from China
Proxy use to access Soaring Eagle PTR is NOT allowed.
By signing up and actively using the
Soaring Eagle PTR
program you agree to all terms and conditions set forth in this agreement.
Soaring Eagle PTR
may, at any time, choose to edit, add and/or delete portions of this agreement
and impose changes without prior notification of its affiliates. Affiliates will
be informed of any and all changes to this policy via an e-mail to their primary
contact e-mail address provided upon signing up with
Soaring Eagle PTR, or by an administrators message sent to all members of the site.
If any modification is unacceptable to you, your only recourse is to terminate
this agreement by canceling your account. Your continued participation in the
Soaring Eagle PTR
program following our posting of a change in policy notice or new agreement on
our site will constitute binding acceptance to the change.
Relationship of the Parties:
You and
Soaring Eagle PTR
are independent contractors, and nothing in this Agreement creates any partnership,
joint venture, agency, franchise, sales representative or employment relationship
between you and
Soaring Eagle PTR
. You understand that you do not have authority to make or accept any offers or
make any representations on behalf of
Soaring Eagle PTR. You may not make any statement, whether on your site or otherwise, that would
contradict anything in this section. You are solely responsible for the reporting
and payment of any taxes for money earned while using the program.
Responsibility of Affiliates:
- You must read and understand english
- You must be 18 years of age or older to participate in this program. Our program
is open to both US and International affiliates, except for China, and is void where prohibited by
local governing laws.
- You agree to and must use your own name and e-mail address in the sign-up process
and may not assume a false identity.
- You may not sign-up multiple times with different
e-mail addresses.
- Your computer must not be shared with another individual that
has an existing
Soaring Eagle PTR
account.
- You will use your e-mail address / password combination to access your account,
it is your responsibility to keep this information confidential, you may change
this information by logging into your account and following the "User Account
Info." link.
- You are solely responsible for any and all use of your
Soaring Eagle PTR
account including authorization by you to any third party individual who may use
your account.
- You must maintain your e-mail account that you used when signing up with
Soaring Eagle PTR.
- You agree to receive e-mail advertising from
Soaring Eagle PTR.
- In the event your e-mail account on file becomes closed or blocked to messages
from
Soaring Eagle PTR
, your account will be terminated. This especially applies to e-mail accounts
returned for being Full.
- Any member sending us gibberish will result in automatic
termination of account and Forfeiture of All earnings to date of termination
- Auto-responses will also be deleted immediately.
Should any instances of fraud, system abuse, or any type of activity deemed to
be inappropriate or illegal by
Soaring Eagle PTR
be detected it will result in member termination and possible legal action. Any
solicitation of advertisers for a confirmation e-mail for purposes of receiving
credit in your account will be grounds for immediate termination.
Cheating and Soaring Eagle PTR:
Cheating is NOT allowed here. If you are found cheating either by use of Email Program Optimizers or other "cheating" software, multiple accounts on a single computer, we WILL delete your account. Once an account is deleted for cheating there is NO WAY to get it back and you will lose all personal earnings, referrals, affiliate pages, and downline earnings.
If you are found cheating or defrauding Soaring Eagle PTR either by use of Email Program Optimizers or other "cheating" software, bot clicking, etc. Your accounts will be immediately deleted at all PTR sites owned and operated by PTR Associates.
Cheating includes, but is not limited to:
- Creating multiple accounts
- Incorrect information or jibberish in your account information
- Clicking 3 cheat links
- Use of automated clicking software
- Use of any browser plug ins, or any browser that automates the clicking for you
- Allowing third party access to your account
- Use of a proxy to access Soaring Eagle PTR
Or any form or combination of the above. Do not do it. I WILL find you.
Cheat Links, English Tests and Turing Numbers:
- Cheat Links - Each cheat link will have a 0 second timer which will deduct 5c from your account and is IRREVERSIBLE under any circumstances. Clicking on 3 or more cheat links will result in automatic termination of account and forfeiture of all earnings to date of termination.
- English Tests - English Tests will be given all members on a regular, random basis. All advertisements sent are in English, therefore you must be able to read and understand English. Failing 3 English tests will result in automatic termination of the member's account and forfeiture of all earnings, referrals, and affiliate pages, to date of termination.
- Turing Numbers - Clicking on 30 or more wrong turing numbers in a month will result in automatic termination of your account and forfeiture of all earnings to date of termination. If you have a vision problem - please contact us.
Activity requirement for ALL members:
You account will be considered inactive if you do not log in AND click at least once every 20 days.
Account Suspensions:
If you are suspended for inactivity or any other reason, you have seven days to contact us to resolve the issue.
If after seven days we have not heard from you, your account will be purged from the system and can not be restored. All earnings will be lost and will NOT be restored under any circumstances.
Site Support:
Site support is not available from 10pm EST Fridays through 8am EST Mondays. All support request sent during that time will be answered after 8am EST Monday.
Free 3 month upgrade for NEW MEMBERS JOINING AFTER JANUARY 10, 2008 ONLY:
We are currently offering a free 3 month upgrade for NEW members of Soaring Eagle PTR.
To qualify for this upgrade, you must be a member in good standing for 30 days. After that time, please contact us to request your free upgrade.
To keep the free upgrade you must stay in compliance with the activity requirements for all members.
If your account becomes inactive, your free upgrade will be removed and not reinstated.
We reserve the right to withdraw this offer at any time without prior notice.
Payments:
Affiliates may earn by receiving paid-emails and visiting the advertiser websites
after they have entered their member ID in the area on the website provided by
Soaring Eagle PTR. Affiliates may earn by referring new affiliates to the
Soaring Eagle PTR
program. Affiliates will earn a percentage of advertising revenues collected by
Soaring Eagle PTR
Soaring Eagle PTR
will pay affiliates when their balance reaches the minimum payout rate set by
Soaring Eagle PTR. Once the member has reached payout they may request payment. Payments will be made within 30 days or a reasonable time after.
Limitation of Liability:
Soaring Eagle PTR
will not be liable for lost profits, lost business opportunities, or any other
indirect, special, punitive, incidental or consequential damages arising out of
or related to this Agreement or
Soaring Eagle PTR
program, even if
Soaring Eagle PTR
has been advised of the possibility of such damages. Furthermore,
Soaring Eagle PTR
aggregate liability arising under this Agreement will not exceed the amount of
the total fees paid or payable to you under this Agreement. The provisions of
this Section survive termination or expiration of the Agreement.
Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING),
newsgroup postings, or any other method of mass communication. Failure to comply
will result in immediate termination of your affiliateship with
Soaring Eagle PTR
and may result in legal prosecution.
Soaring Eagle PTR
strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member
caught Spamming will not only have their account terminated immediately and lose
any past, present and future earnings, but shall also be held liable for Spamming
as we shall cooperate with any authorities and investigations that may arise from
the Spamming incident.
Soaring Eagle PTR
may charge up to $50.00 per spam e-mail sent.
